At whose expense should the elevator repair be carried out?

It is difficult to imagine a modern high-rise building without an elevator. Even in low-rise buildings, elevators are installed on 5 floors today. When the mechanism breaks down, residents experience discomfort, because they have to climb the stairs to the desired floor.

Elevators are complex systems and contain many parts that require regular maintenance to ensure a safe, smooth and trouble-free ride for passengers. Upgrading an elevator system involves a significant investment and is a major undertaking with complexities that also impact HVAC, electrical, and fire safety systems.

Obviously, the services of the company servicing the elevators must be paid. Almost always, these payments are made by the residents of the apartment building.

Who is responsible for the condition of the elevators?

The answer to this question depends on who owns the building. According to the Law “On Housing Relations”, the elevator belongs to common property. In apartment buildings, apartment owners are responsible for the maintenance and repair of elevator equipment. This may include annual maintenance, regular replacement of parts and components, and repairs in the event of breakdown.

Owners can enter into an agreement for the maintenance and repair of common household property with a management company. If there is such an agreement, she is responsible for the condition of the elevator equipment, which belongs to the general property of the facility.

The management company may hire third-party organizations with suitable material and technical base and personnel for maintenance, major repairs and modernization of elevators.

Maintenance plans typically include monthly system inspections by certified technicians, during which they can identify and fix small problems before they become major failures that can disrupt the operation of the elevator equipment. Residents pay for contractors' services through monthly contributions.

Who should pay for elevator repairs?

Elevator equipment is a common property, so the owners themselves pay for its maintenance. If the property is located in an apartment building, then the costs of repairs are usually distributed among the residents. This can be implemented in different ways:

  • through monthly maintenance fees;
  • a different payment procedure approved at a meeting of residents;
  • participation in the state program for capital repairs of elevators.

In any case, if you have questions regarding elevator repairs, you should contact the management company to clarify issues of liability and repair procedures. According to Article 42-1 of the Law “On Housing Relations”, apartment owners at the meeting consider issues and make decisions related to the management of the common property of the object. At the meeting, a decision may be made to introduce additional fees or contributions for the repair of elevator equipment. The meeting has the right to make a decision if more than half of the total number of apartment owners participate in it.
